Civil and Commercial

It is everybody’s hope that their dealings and relationships, be they personal or commercial, will go smoothly and exactly as planned. In reality, misunderstandings and disputes are sometimes inevitable, especially when one or more parties have not kept their end of the bargain. When this happens, it is in the best interest of all parties to attempt to resolve the dispute in the most expeditious and cost-effective manner. The laws governing such disputes are collectively known as civil law (as opposed to criminal law). Where these disputes involve commercial transactions such as the sale of goods and services, they are known as commercial disputes and are governed by a set of civil laws known as commercial laws.

Dispute Resolution

Our firm is well acquainted with the various methods of dispute resolution. Our litigation lawyers take the time to study and develop an in-depth understanding of every dispute that is referred to them in order to determine the best method to attempt to resolve the dispute. From direct negotiations with opposing parties and their lawyers to Alternative Dispute Resolution (ADR) mechanisms including mediation and arbitration, our lawyers will walk you through your options, advise you on the pros and cons of each option and ensure that you are regularly updated throughout the dispute resolution process.

Litigation

Despite the array of dispute resolution mechanisms available, some disputes can only be resolved within the confines of a courtroom. Should this be the case, rest assured that you are in good hands regardless of the value of the subject matter or the complexity of the dispute. Our lawyers handle a wide range of cases including but not limited to those in relation to land and property, banking and finance, trusts, contractual and tortious claims, landlord-tenant disputes, shareholder and director disputes and contentious estate matters. We take pride in the fact that in many instances, we have assisted the courts in redefining the law over the last six decades.

Drafting of Agreements

Having one’s dealings – particularly commercial dealings – governed by well-drafted agreements goes a long way towards expediting the settlement of disputes or even preventing them outright. That is why over the decades, our clients have entrusted us with the drafting and vetting of various types of commercial agreements including joint venture, partnership and shareholders’ agreements as well as banking facility agreements, including those based on Islamic principles. Our commitment is to ensure that our clients’ agreements are comprehensive, clear and well suited to their requirements.
